Terms of Service

These are the rules for using wisebuild.homes and for paying rent through it. They are written to be read — short sentences, no more words than the point needs. The sections about payments start at section 6.

WiseBuild manages rental homes and supplies construction materials in Clarksdale, Mississippi. This page covers both, and it covers paying rent online.

Three things are worth reading even if you read nothing else. A payment counts when it clears, not when you submit it (section 8). Paying by card costs 3%; paying by bank transfer or money order is free (section 9). And where this page and your signed lease disagree, your lease wins (section 17).

Agreement to these terms

1.1
These Terms of Service (the Terms) apply to the WiseBuild website at wisebuild.homes, to everything you can do on it, and to the services WiseBuild provides through it. In these Terms, WiseBuild, we and us mean WiseBuild; you means the person using the site or the service.
1.2
By using this website, submitting a form, requesting a quote, ordering materials, or making a payment, you agree to these Terms. If you do not agree, please do not use the site.
1.3
If you are a tenant, you also have a signed lease. These Terms sit alongside that lease. They do not replace it. Where these Terms and your signed lease disagree, your signed lease governs — see section 17.
1.4
You must be at least 18 years old to enter into these Terms.

Who we are and what we do

WiseBuild is one company running two lines of business out of Clarksdale, Mississippi:

  • Rental property management. We list, lease, maintain and manage rental homes, mostly in and around Clarksdale, Mississippi. We collect rent for the properties we manage and remit it to the property owners.
  • Construction material supply, renovation and repairs. We supply building materials and carry out renovation, repair and construction work.
2.1
Both lines are the same company, and payments for both may be processed through the same payment processor. Your receipt and your bank statement will identify which one a charge belongs to.
2.2
On the properties we manage, WiseBuild usually acts as the manager or agent for the property owner. Who your landlord is, is stated in your lease.
2.3
We may change, suspend or stop any part of the website or the services at any time. We will not do that in a way that takes away a right you have under your lease.

Using this website

3.1
Give us accurate information. If you enter someone else’s address, the wrong amount, or a phone number or email that is not yours, we cannot apply your payment correctly and we may not be able to reach you.
3.2
Keep your information current. Tell us when your phone number, email address or bank account changes. We send receipts, failed-payment notices and advance notice of automatic debits to the email and phone we have on file.
3.3
Do not use this site to break the law, to try to access another person’s account or balance, to interfere with the site, or to scrape, copy or resell what is on it.
3.4
Some parts of the site are protected by a sign-in or by a verification step. Anything done through your sign-in is treated as done by you. Tell us straight away if you think someone else has access.
3.5
Before we show you a rent balance, we ask for the last four digits of the phone number on file for the property. That is to keep a stranger from typing your address and reading your name and what you owe. Do not share a payment link or a balance page with anyone you would not want seeing your account.

Property listings are information, not offers

4.1
Listings, photographs, videos, floor plans, rent figures and availability on this site are for information only. They are not an offer to lease or to sell, and nothing on this site creates a lease.
4.2
A tenancy begins only when a written lease is signed by you and by us or the property owner, and any required deposit is paid.
4.3
We try to keep listings accurate and current, but a property may be leased, withdrawn or repriced before the site is updated. Photographs and videos may show a similar unit, or the same unit before or after renovation.
4.4
WiseBuild follows fair housing law. We do not refuse to rent, or apply different terms, because of race, colour, religion, sex, familial status, national origin or disability.

Material orders, quotes and construction work

5.1
Prices, stock levels and lead times shown for materials can change. A quote is valid for the period stated on it, or for 30 days if no period is stated.
5.2
An order is accepted when we confirm it, not when you submit it. If something is out of stock or priced wrongly, we will tell you and you can cancel.
5.3
Renovation and repair work is governed by the separate written scope, quote or contract for that job. Where that document and these Terms disagree, that document governs for that job.
5.4
Returns on materials are handled case by case. Custom-cut, special-order and used materials are generally not returnable. Ask us before you buy if this matters to you.

Rent, due dates and late fees

Rent is due on or before the 1st of each month. A payment received after the 5th day of the month incurs a $50 late fee.

6.1
That is the language of the lease you signed. This page restates it. It does not change it.
6.2
The late fee is $50.00, flat, once per month, and it is charged from the 6th day of the month if any rent for that month is still outstanding.
6.3
A late fee is a fee, not rent. We record it separately from rent, and money you pay is applied to your oldest outstanding balance first — see section 12.
6.4
Late fees are charged on the basis of when a payment clears, not when it is submitted. See section 8. If you pay by bank transfer, allow 3 to 5 business days.
6.5
Continued delinquent payment may result in termination of the lease, as the lease states.
6.6
We may waive a late fee at our discretion. Waiving one does not waive any other, and does not waive the underlying rent.

Ways to pay your rent

You can pay your rent in these ways:

  • Bank transfer (ACH) — no fee. This is the method we recommend and the one selected for you by default.
  • Money order — no fee. We give you a reference number and the address to mail it to.
  • Credit or debit card — a 3% processing fee applies. See section 9.
7.1
Bank transfer and money order are always available to you, at no fee. You never have to pay a fee to pay your rent.
7.2
You choose the method on our page, before you go anywhere else. You can go back and change it, or cancel, at any point before you submit the payment. Nothing is charged until you submit.
7.3
We may also accept cash or a check at our office. Always get a receipt. Never mail cash.
7.4
Money orders are not applied to your balance until we receive and deposit them. Mailing a money order is not payment; see section 8.

When a payment is considered made

Submitting a payment is not the same as paying. A payment counts only when the money reaches us and clears.

8.1
Your rent is paid when the payment clears — that is, when the money has actually moved and your bank or card issuer can no longer pull it back as a failed payment. It is not paid when you press the button, not when you see a confirmation screen, and not when you receive an email saying we have received your instruction.
8.2
How long clearing takes, typically:
  • Bank transfer (ACH) — 3 to 5 business days.
  • Card — usually the same or the next business day.
  • Money order — when we receive it in the mail and deposit it.
8.3
Until a payment clears, your balance does not change. Our records may show the payment as pending. Pending is not paid.
8.4
If a payment fails, is returned by your bank, is declined, or is reversed after it appeared to succeed, then it never counted as payment. The amount goes back onto your balance, and the rent it was meant to cover is treated as unpaid from its original due date — the 1st of the month — not from the day the payment failed. Any late fee that would have applied still applies.
8.5
Bank transfers can fail days after you submit them — for insufficient funds, a closed account, or an authorisation your bank does not accept. That is normal for this kind of payment. It means a balance can correctly show as paid and then go back to unpaid several days later.
8.6
We email you when a payment clears and when a payment fails. Please read those emails, and please keep the receipt.
8.7
To be safe, pay early. If you pay by bank transfer on the 5th, it will usually not clear until after the 5th, and the late fee in section 6 will apply.
8.8
We are not responsible for delays caused by your bank, your card issuer, our payment processor, or the mail. We are also not responsible for any overdraft, insufficient-funds or other charge your own bank applies to you.

The 3% card processing fee

Paying by card costs 3% of the rent you are paying. Paying by bank transfer or money order is free.

9.1
If you pay by credit card or debit card, WiseBuild adds a processing fee of 3% of the rent amount you are paying. On $800.00 of rent the fee is $24.00, and the total charged to your card is $824.00.
9.2
Bank transfer (ACH) and money order are always available at no fee. The fee applies to card payments only. There is no fee on a bank transfer, a money order, cash or a check. Bank transfer is selected for you by default because it is the free option.
9.3
You see the fee as a dollar amount, before you submit — beside the card option when you choose it, again on the confirmation step with the rent, the fee and the total set out separately, and again as its own line on the checkout page. You may go back, choose a different method, or cancel at any point before you submit. Nothing is charged until you submit.
9.4
The fee is charged by WiseBuild to offset what card networks and our payment processor charge us for accepting cards. It is not a charge by your bank and it is not a charge by the card network.
9.5
The fee is not rent. It is not credited against your balance and it does not reduce what you owe. If you pay $824.00 by card against $800.00 of rent, $800.00 is applied to your rent and $24.00 is the fee. Your balance goes down by $800.00, not by $824.00.
9.6
The fee is shown as its own line on your receipt and is recorded separately from rent in our books.
9.7
Once a card payment clears, the fee is non-refundable — including where the rent itself is later refunded, credited, reversed or charged back. The fee pays a cost we have already incurred.
9.8
If a card payment does not clear, no fee is kept.
9.9
We may change the percentage in the future. Any change applies only to payments made after we publish it, and the amount you are charged is always shown to you in dollars before you submit.
10

Bank transfer (ACH) authorisation

10.1
When you submit a bank transfer, you authorise WiseBuild — and our payment processor acting for us — to debit your bank account for the amount you entered, on or after the date you submit it.
10.2
You confirm that the account is yours, or that you are authorised to debit it, and that the details you gave are correct.
10.3
A bank transfer normally takes 3 to 5 business days to clear. See section 8 for what that means for your balance.
10.4
You can cancel a bank transfer only before it is submitted for processing. Once it is submitted, contact us immediately at info@wisebuild.homes or +1 662 592 2946 and we will tell you what can still be done. You also have whatever rights your own bank gives you to dispute a debit.
10.5
If a debit is returned unpaid, the balance it was meant to cover stays outstanding, and section 13 applies.
10.6
This authorisation is for the single payment you submitted. A standing authorisation for automatic monthly payments is separate, and is covered in section 11.
11

Automatic payments (autopay)

11.1
Autopay is optional. If you enrol, you authorise us to debit your bank account each month, on a recurring basis, for the rent then outstanding, until you cancel.
11.2
Autopay is available for bank transfer only. We do not offer autopay on cards, so that nobody is enrolled into paying the 3% fee automatically every month.
11.3
Each debit is for the balance outstanding on your account, and is never more than one month’s rent.
11.4
We email you at least 3 days before each debit, with the amount, the date, and a link to cancel.
11.5
You can cancel autopay at any time — use the cancel link in any autopay email, or contact us. Cancel before the notice period ends, or that month’s debit may already be on its way. Cancelling is free.
11.6
Cancelling autopay stops future debits. It does not cancel rent you owe and it does not stop late fees.
11.7
If two autopay debits fail in a row, we switch autopay off and tell you. You then need to pay another way, and re-enrol if you want autopay back.
11.8
Autopay payments clear the same way as any other bank transfer, and section 8 applies to them in full.
12

Partial payments

12.1
You can pay part of what you owe. Paying something is better than paying nothing, and we would rather you did.
12.2
Any money we receive is applied to your oldest outstanding balance first, and then forward in time, unless we agree otherwise in writing. We decide how a payment is applied — a note on a money order, in an email, or on a check does not direct it.
12.3
Accepting a partial payment does not waive the rest of the balance. It does not waive any late fee, it is not a new agreement about when the rest is due, and it is not a settlement of the amount owed.
12.4
Accepting a partial payment also does not waive any right or remedy available to WiseBuild or to the property owner — including the right to charge late fees, to serve notice, to terminate the lease, or to bring an eviction or collection action. Writing “paid in full”, “final payment” or anything similar on a payment does not make it so, and cashing such a payment is not our agreement to it.
12.5
Where an eviction or collection action has already started, accepting a payment does not stop it unless we say so in writing.
12.6
There is a small minimum payment amount, shown on the payment page.
13

Returned and reversed payments

13.1
A payment can be returned or reversed after you submitted it — for insufficient funds, a closed or frozen account, a stopped payment, wrong account details, or a card dispute.
13.2
When that happens, the amount goes back onto your balance and the rent is treated as unpaid from its original due date. See section 8.4.
13.3
A returned payment may incur a returned-payment fee, to the extent your lease and Mississippi law allow, in addition to any late fee. Your own bank may also charge you. We will tell you the amount of any returned-payment fee before we charge it.
13.4
If payments from you are returned repeatedly, we may require that future rent be paid by money order or certified funds.
14

Refunds, chargebacks and disputes

14.1
If you think a payment is wrong — the wrong amount, the wrong property, a duplicate, or one you did not authorise — please contact us first, at info@wisebuild.homes or +1 662 592 2946. Most problems are a data-entry mistake and we can fix them faster than a bank can.
14.2
Rent that has been correctly applied to your balance is generally not refundable. Where a refund is due — a duplicate payment, an overpayment, or an amount charged in error — we refund it to the same method you paid with, normally within 5 to 10 business days.
14.3
The 3% card fee is not refunded once the payment has cleared. See section 9.7.
14.4
Contacting us does not take away any right you have to dispute a charge with your bank or card issuer. But a chargeback does not cancel rent you owe. If a chargeback reverses a rent payment that had cleared, the balance comes back and the rent is unpaid from its original due date.
14.5
Deposits, and how they are returned at the end of a tenancy, are governed by your lease and by Mississippi law, not by this section.
15

Payment processing

15.1
Card and bank payments on this site are processed by Stripe, Inc., not by WiseBuild. When you pay, you are sent to a checkout page hosted by Stripe.
15.2
Your card number, bank account number and routing number are entered on Stripe’s page. They never reach WiseBuild’s servers and are never stored in our database. We receive only what Stripe passes back to us — the amount, the status, the type of method, and the last four digits.
15.3
Your use of Stripe’s checkout is also subject to Stripe’s own terms and privacy policy. See stripe.com/legal/consumer and stripe.com/privacy.
15.4
We are not responsible for an outage, delay or error at Stripe or at your bank. If checkout is down, use a money order or contact the office — rent is still due.
15.5
How we handle your information is set out in our Privacy Policy.
16

Maintenance requests

16.1
Submitting a maintenance request through this site is a request, not an appointment. We confirm scheduling separately.
16.2
Do not use this website for an emergency. For fire, gas, a serious water leak, or anything that endangers someone, call 911 first, then call us at +1 662 592 2946.
16.3
Repairs that are the tenant’s responsibility under the lease, and damage beyond normal wear and tear, may be charged to the tenant, as the lease provides.
16.4
A pending maintenance request is not a reason to withhold rent. If you believe a condition entitles you to withhold, talk to us — and get advice — before you do.
17

Your lease comes first

17.1
If anything on this page conflicts with the lease you signed, the lease governs. These Terms are not an amendment to your lease, and using this website does not change your lease.
17.2
Nothing on this page takes away a right you have under Mississippi landlord-tenant law.
17.3
The rent due date and the $50 late fee in section 6 are stated here because they are already in your lease — not in addition to it.
18

Emails, notices and records

18.1
You agree that we may contact you by email at the address we have on file about your payments — receipts, failed payments, balance reminders, and notice before an automatic debit.
18.2
You can ask us to stop sending balance reminders. We will still send the records of money moving — receipts, failed-payment notices, and advance notice of an automatic debit — because you need those. Opting out of emails does not clear a balance and does not stop late fees.
18.3
Formal legal notices under your lease are given the way your lease says, not by email, unless your lease allows email.
18.4
Our records of payments — amount, method, status and dates — are the records we rely on. If you think a record is wrong, tell us and send us what you have.

Intellectual property

19.1
The WiseBuild name and logo, and the text, photographs, videos, layout and design of this site, belong to WiseBuild or to the people we licensed them from. They are protected by copyright and trademark law.
19.2
You may view, print and share pages of this site for your own non-commercial use — including printing your receipt or these Terms. You may not copy our listings, photographs or videos for another business, or republish them, without our written permission.
19.3
If you send us a photograph or video — for example with a maintenance request — you keep ownership of it, and you give us permission to use it to handle your request and to keep it in our records for the property.

Disclaimers

20.1
The website is provided “as is”. We do not promise that it will always be available, error-free, or free of interruption.
20.2
Information on the site — listings, availability, prices, balances, estimates and timescales — can be out of date or contain a mistake. Where it matters, confirm it with us.
20.3
Nothing on this site is legal, tax or financial advice.
20.4
To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement in relation to the website.
20.5
This section applies to the website. It does not limit our obligations as landlord or manager under your lease, or under Mississippi law, including any duty to maintain the premises.
21

Limitation of liability

21.1
To the fullest extent the law allows, WiseBuild is not liable for indirect, incidental, special or consequential losses arising out of your use of this website — for example lost income, or a fee your own bank charges you.
21.2
To the fullest extent the law allows, our total liability arising out of your use of this website is limited to the amount of fees you paid us through the website in the 12 months before the claim. This cap does not apply to rent or deposits held on your account.
21.3
Nothing in these Terms limits liability for fraud, for a wilful act, for death or personal injury caused by our negligence, or for anything else that cannot be limited under Mississippi law — including our obligations as a landlord.
21.4
Some of what is above may not apply to you, because some limits are not allowed in every situation. Where a limit is not allowed, it does not apply and the rest of these Terms still stands.
22

Governing law and where disputes are heard

22.1
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-laws rules.
22.2
Any dispute arising out of these Terms or your use of this website is brought in the state or federal courts serving Coahoma County, Mississippi, and both of us agree to those courts.
22.3
Landlord-tenant matters — eviction, deposits, habitability — go to the court that Mississippi law says hears them, wherever that is.
22.4
Before filing anything, please contact us. Most disputes about money on this site are a mistake somebody can fix in a phone call.
22.5
If part of these Terms is found unenforceable, the rest stays in force. Our not enforcing a term on one occasion is not a waiver of it.
23

Changes to these terms

23.1
We may update these Terms. When we do, we change the Last updated date at the top of this page.
23.2
Changes apply from the day they are posted, and to payments made after that day. They do not change a payment you already made.
23.3
If a change materially affects how you pay rent or what it costs you, we will tell tenants by email as well as posting it here.
23.4
We cannot change your lease by changing this page. See section 17.
